Why this matters.
The Tobacco and Vapes Act 2025 introduces the UK’s “smokefree generation” policy — anyone born on or after 1 January 2009 will never be legally sold tobacco products, with the age of sale rising by one year every year from 2027. It also gives ministers powers to restrict vape flavours, packaging, point-of-sale displays and advertising, extends smoke-free rules to more outdoor places such as school gates and playgrounds, and bans branded vape marketing that could appeal to children. Separately, the Single-use Vapes (England) Regulations 2024 already make it illegal to sell or supply disposable (single-use) vapes from 1 June 2025, with equivalent bans in Scotland, Wales and Northern Ireland. Trading Standards has been actively enforcing age-of-sale and disposable vape rules, with test purchases, seizures and fixed penalty notices reported across the country. Retailers, vape shops, convenience stores and hospitality venues selling tobacco or vaping products need Challenge 25 processes, compliant point-of-sale displays, and a plan for phasing out disposable stock — getting caught out risks fines, product seizure and loss of a premises licence in some areas.
