Why this matters.

The EU Machinery Regulation, Regulation (EU) 2023/1230, replaces the Machinery Directive 2006/42/EC and applies from 20 January 2027. Because it is a regulation, it applies directly in every Member State with no national transposition. It covers manufacturers, authorised representatives, importers and distributors of machinery and related products such as interchangeable equipment, safety components, lifting accessories and partly completed machinery. Before machinery can be placed on the EU market it must meet the essential health and safety requirements in Annex III, be supported by technical documentation, carry an EU declaration of conformity and bear the CE marking.

The Regulation brings real changes for small manufacturers and resellers. Instructions may now be supplied in digital form, but a paper copy must be provided free of charge if the customer asks at the time of purchase. Annex I lists high-risk machinery, and six categories, including safety components with fully or partly self-evolving behaviour using machine learning, always need a third-party notified body assessment. Annex III adds requirements on protection against corruption (cyber security) and on autonomous and AI-driven machinery. Anyone who substantially modifies machinery already in use, including an end user or integrator, can take on the manufacturer’s obligations under Article 18. Member States set the penalties and market surveillance authorities can force withdrawals and recalls, so January 2027 is the deadline to have your products and paperwork ready.
